These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and fullday.inc ("Company," "we," "us," or "our") regarding your use of the Ourkids mobile application and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

Ourkids is a digital diary application designed for parents to create and maintain diary entries about their children. The Service allows you to:

• Create and manage a personal account
• Write diary entries with text and photos
• Store and organize your diary content
• Access your diary entries through the mobile application

3.1 Age Requirements

• You must be at least 13 years old to use this Service
• The Service is intended for parents and legal guardians
• You represent that you have the legal authority to create diary entries about the children referenced in your content

3.2 Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account

4.1 Your Content

• You retain ownership of all diary entries, photos, and other content you create ("User Content")
• You are solely responsible for your User Content and the consequences of posting or publishing it
• You represent that you have all necessary rights to the content you upload

4.2 Content Standards

You agree that your User Content will not:

• Violate any applicable laws or regulations
• Infringe upon the rights of any third party
• Contain harmful, threatening, or abusive material
• Include inappropriate content involving minors
• Contain malicious code, viruses, or other harmful components

4.3 Content License

By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit your content solely for the purpose of providing the Service to you.

You may not use our Service to:

• Violate any local, state, national, or international law
• Share accounts or allow unauthorized access to your account
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Use the Service for any commercial purpose without our express consent
• Upload content that violates these Terms or our Privacy Policy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy.

7.1 Service Provision

• We strive to provide reliable access to our Service
• We do not guarantee that the Service will be available at all times
• We may modify, suspend, or discontinue the Service with or without notice

7.2 Maintenance and Updates

• We may perform maintenance or updates that temporarily affect Service availability

8.1 Our Responsibilities

• We use reputable third-party services (Supabase, DigitalOcean) for data storage
• We cannot guarantee absolute security of data transmitted over the internet

8.2 Your Responsibilities

• You are responsible for maintaining backup copies of important content
• You should regularly export or backup your diary entries if desired

9.1 Termination by You

• You may terminate your account at any time using the in-app deletion feature
• Upon termination, all your data will be permanently deleted as described in our Privacy Policy

9.2 Termination by Us

We may terminate or suspend your account if you:

• Violate these Terms
• Engage in harmful or illegal activities
• Provide false information during registration

10.1 Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FULLDAY.INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

You agree to indemnify and hold harmless fullday.inc, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

12.1 Our Rights

• The Service, including its design, functionality, and code, is owned by fullday.inc
• Our trademarks, service marks, and logos are the property of fullday.inc
• You may not use our intellectual property without express written permission

12.2 Your Rights

• You retain all rights to your User Content
• These Terms do not transfer any ownership rights to us beyond the limited license described above

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting updated Terms within the application
• Sending notice to your registered email address for significant changes

Continued use of the Service after changes constitutes acceptance of the modified Terms.

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of South Korea, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Korea.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
